The Advisory Board is currently considering having a section on updates in applicable estate planning law.  The content is expected to be prepared or reviewed by lawyers with expeirence in the law and practices of estate planning.

The Fauquier Circuit Court would not uphold a transfer of real estate to a Trust where the durable Power of Attorney ("PoA") did not include specific powers for estate planning nor that the attorney in fact under the PoA could make herself a beneficiary of the Trust.
